Cebu road rage shooting suspect David Lim Jr., who spent two nights at the Cebu City Police Office (CCPO) holding cell, on Thursday afternoon posted a bail of PHP144,000 for his temporary liberty.

Assistant Cebu City Prosecutor Ma. Theresa Casiño found probable cause to charge Lim, 28, a scion of one of the wealthiest families in Cebu, with frustrated homicide and illegal possession of ammunition at the Regional Trial Court in Cebu City.

The two criminal cases were in relation to the shooting and wounding of nurse Ephraim Nuñal following a traffic altercation before dawn Sunday.

Casino set the bail for Lim’s temporary liberty at PHP24,000 for the case of illegal possession of ammunition and PHP120,000 for frustrated homicide.

Lim was originally charged with frustrated murder by the CCPO Homicide section upon the advice of the counsel of the victim’s family.

But Casino said she downgraded the case from frustrated murder to frustrated homicide because there was no proof of treachery against the accused in shooting Nuñal in the left thigh and right ankle.

“A judicial examination of the evidence at hand would show that there are not sufficient basis to prove the existence of any of the circumstances stated therein (murder case),” Casiño said in her resolution of the case.

The resolution was approved by Cebu City Prosecutor Liceria Lofranco-Rabillas.

Lim’s bail was still being processed as of 3 p.m. Thursday, but his counsel, Orlando Salatandre Jr., assured he would be able to go home today. (PNA)EB/EDS
