Apple Halts Sales of Apple Watch Series 9, Ultra 2 Amid Patent Issue

Apple has officially announced the suspension of sales for its new flagship Apple Watch models, the Series 9 and Ultra 2, in the United States.

In an article first reported by 9to5Mac, the decision followed a recent ruling by the International Trade Commission (ITC) as part of a protracted patent dispute between Apple and medical technology firm Masimo concerning the Apple Watch’s blood oxygen sensor technology.

The ITC ruling, issued in October, found Apple in violation of two patents related to the Apple Watch’s pulse oximeter feature, prompting Apple to preemptively take steps to comply with the ITC’s decision. As of December 21, Apple Watch Series 9 and Ultra 2 will no longer be available for purchase on Apple’s website, with in-store inventory ceasing after December 24.

The ITC’s ban specifically targets these models due to their blood oxygen monitoring capabilities, while the lower-end Apple Watch SE, lacking this feature, remains unaffected and available for purchase. The ITC order prevents Apple from importing the affected models to the U.S. after December 25, potentially impacting availability through other retailers.

In response, Apple expressed strong disagreement with the ITC’s decision, emphasizing its commitment to legal and technical avenues to ensure the availability of Apple Watch to customers. The company argues that the ruling could adversely affect its suppliers, consumers, and even ongoing health studies relying on the Apple Watch.

As the Presidential Review Period expires on December 25, the Biden administration could still veto the ITC ban. Apple intends to file an appeal on December 26, while exploring potential settlements, licensing agreements, or design changes to address the patent infringement allegations. (GFB)
