‘COA REPORT DISCREDITED’

Lawyer Juan Carlos Mendoza, counsel of former Makati Mayor Elenita Binay, in a statement, said that Ms. Heidi Mendoza should have been candid enough to admit before the Senate hearing that the Audit Report she was testifying last week was already discredited by the Sandiganbayan. In the same statement, Mendoza revealed that in a Resolution dated April 7, 2011, the Second Division of the Sandiganbayan found that the audit procedures adopted by COA suffers from “fundamental issues of arbitrariness” by reason of which the case against Dra. Binay and the other members of the Bids and Awards Committee were dismissed.

The Sandiganbayan Resolution was affirmed by no less than the Supreme Court on 12 January 2012, it added.
